1. Agreement to Terms

By accessing or using RawHabit.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and HootCodes LTD ("Company", "we", "us", or "our"), a company registered in Bulgaria.

2. Description of Service

RawHabit.ai is an accountability-first habit tracking application that:

• Tracks habit completion with yearly countdown targets
• Enforces accountability through the "Raw Screen" excuse validation system
• Uses AI to challenge and validate excuses for missed habits
• Verifies habit completion through optional photo proofs
• Enables social features including friend connections, challenges, and leaderboards
• Sends push notifications for habit reminders and accountability alerts

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws and regulations
• You will not use the Service for any illegal or unauthorized purpose

4. User Accounts

4.1 Account Creation

To use the Service, you must create an account using Google OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Immediately notify us of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through the app settings.

5. Trial Period

New users receive a ONE-TIME trial period to test the Service. The trial:

• Is offered once per user account (non-transferable)
• Provides full access to all features during the trial duration
• Cannot be extended or reactivated once used
• Automatically expires after the trial period ends
• Requires no payment information to activate

After the trial expires, you must subscribe to continue using the Service.

6. Subscriptions and Payments

6.1 Discipline Commitment Model

RawHabit.ai operates on a "discipline commitment" payment model. You choose how much to pay as a commitment to your accountability:

• Weekly: Minimum $2, recommended $5 per week
• Monthly: Minimum $6, recommended $20 per month

6.2 Payment Processing

• All payments are processed securely through Stripe
• Subscriptions automatically renew unless canceled
• You can cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period

6.3 No Refund Policy

7. User Content and Conduct

7.1 Your Content

You retain ownership of all content you submit to the Service, including:

• Habit names and descriptions
• Excuse explanations and AI conversation history
• Photo proofs of habit completion
• Comments and messages to friends

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely for providing and improving the Service.

7.2 Prohibited Conduct

You agree NOT to:

• Upload illegal, offensive, or inappropriate content
• Harass, abuse, or harm other users
• Attempt to manipulate or game the system
• Reverse engineer or attempt to extract the source code
• Use the Service to spam or distribute malware
• Violate any applicable laws or regulations
• Impersonate others or create fake accounts
• Scrape or collect data from the Service without permission

8. AI-Generated Content

The Service uses AI (OpenAI's GPT models) to:

• Validate and challenge excuses for missed habits
• Verify photo proofs of habit completion
• Generate personalized challenge messages
• Provide accountability feedback

AI-generated responses are automated and may not always be perfect. We make no guarantees about the accuracy, appropriateness, or tone of AI responses. By using the Service, you acknowledge and accept that AI will challenge your excuses as part of the accountability model.

9. Social Features and Leaderboards

When using social features, you agree that:

• Friends can view your habit completion status and progress
• Your display name and country may appear on leaderboards (you can opt for anonymous display)
• Challenge participants can see shared habit progress
• Comments and interactions are visible to connected friends
• We are not responsible for disputes between users

10. Intellectual Property

The Service, including its design, code, features, and content (excluding user-generated content), is owned by HootCodes LTD and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission.

11. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.

12. Disclaimers and Limitations of Liability

12.1 "As Is" Service

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• The Service will meet your specific requirements
• AI responses will always be accurate or appropriate
• Notifications will always be delivered on time

12.2 Not Medical or Mental Health Advice

12.3 Limitation of Liability

To the maximum extent permitted by law, HootCodes LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, profits, or emotional distress.

13. Indemnification

You agree to indemnify and hold harmless HootCodes LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Content you submit to the Service

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of Bulgaria, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Sofia, Bulgaria.

For users in the EU, you may also have the right to bring proceedings in the courts of your country of residence.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
